MOO-LAH — Terms and Conditions

1. Acceptance of Terms

By accessing or using MOO-LAH ("the Service"), operated by MbuleloAlmighty (Pty) Ltd ("the Company"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service. The Service is available globally and these Terms apply regardless of your country or jurisdiction.

2. Service Description

MOO-LAH is a personal budgeting and finance tracking tool ("Your Cash Cow") that provides financial tracking, AI-powered transaction categorisation, spending analysis, informational budgeting insights, group savings (stokvel) tracking, and goal management. The Service supports users in any country and accepts bank statement uploads from financial institutions worldwide. The Service is an informational tool only and does not provide any regulated financial services, financial advice, or any other service requiring a financial licence in any jurisdiction.

3. No Financial Advice — Important

MOO-LAH does not provide financial advice, investment advice, tax advice, credit advice, insurance advice, or any form of regulated financial guidance under any jurisdiction — including but not limited to South Africa (FAIS Act 37 of 2002), the EU (MiFID II), the UK (FCA), the US (SEC/FINRA), or Australia (ASIC). All AI-generated insights, forecasts, spending analyses, cash flow overviews, scenario simulations, budgeting suggestions, and Tax Deductibles Checker outputs are for personal reference and general informational purposes only. The Tax Deductibles Checker in particular is an educational tool only — it does not constitute tax advice, and outputs must not be relied upon for any tax filing, deduction claim, or submission to any tax authority. No content generated by this Service should be relied upon as a basis for any financial, investment, tax, or legal decision. The Company does not hold a financial services licence, investment licence, credit provider registration, tax practitioner registration, or any equivalent authorisation in any jurisdiction. Users must seek advice from a qualified, licensed financial or tax professional in their own jurisdiction before making any financial decision. The Company accepts no liability whatsoever for financial decisions made based on information provided by the Service.

4. AI Accuracy & Automated Processing

The AI-powered features, including bank statement parsing and transaction categorization, use automated processing and may contain errors or inaccuracies. AI outputs are probabilistic estimates, not definitive results. The Company makes no guarantees regarding the accuracy, completeness, or reliability of any AI-generated categorizations, analyses, simulations, or suggestions. Users are responsible for verifying all parsed data and AI outputs before acting on them.

5. International Use & Local Laws

The Service is available to users worldwide. Users are solely responsible for ensuring that their use of the Service complies with all laws and regulations applicable in their country, state, or jurisdiction, including laws relating to financial data, privacy, and taxation. The Company makes no representation that the Service is appropriate or legally permitted in all locations.

6. User Responsibilities

Users are responsible for: (a) maintaining account security; (b) the accuracy of manually entered data; (c) reviewing all AI-categorized transactions; (d) ensuring compliance with local laws; (e) making all financial decisions independently and with appropriate professional advice.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: (a) use of or inability to use the Service; (b) errors in AI categorization or analysis; (c) statement parsing errors; (d) financial losses resulting from any reliance on the Service; (e) data breaches despite reasonable security measures; (f) any third-party services or integrations.

8. User Indemnification

You agree to indemnify and hold harmless the Company, its directors, officers, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; (d) any financial decisions you make based on content provided by the Service.

9. Markets & Price Data Feature

The Markets feature provides indicative USD price estimates for cryptocurrencies, equities, precious metals, and commodities sourced from public APIs and AI estimation. This feature is for general personal reference and awareness only. It does not constitute financial advice, investment advice, a recommendation to buy or sell any asset, or any form of regulated financial service under any jurisdiction — including but not limited to the South African Financial Advisory and Intermediary Services Act (FAIS), the UK Financial Conduct Authority (FCA), the US Securities and Exchange Commission (SEC) or Commodity Futures Trading Commission (CFTC), or any equivalent authority. Prices shown may be delayed, estimated, or inaccurate and should not be relied upon for any trading, investment, or financial decision. The Company is not a licensed financial services provider, broker, or investment adviser. Users must use regulated brokers and consult a licensed financial adviser before making any investment decisions. The Company accepts no liability for any losses arising from any use of this feature.

10. Responsible Gambling & High-Risk Activities

The Service allows tracking of variable income sources, which may include activities such as online betting or speculative trading. The Service does not promote, endorse, or facilitate gambling. Where such activity types are selected, responsible gambling notices are displayed. Users engaging in gambling or speculative activities should seek guidance from licensed support organisations in their country. The Company is not responsible for any losses arising from such activities.

11. Intellectual Property

All content, features, and functionality of the Service are owned by MbuleloAlmighty (Pty) Ltd and are protected by applicable intellectual property laws.

12. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms. Users may request deletion of their account and data at any time through Settings.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via the app or email.

14. No Credit or Lending Facilitation

MOO-LAH does not facilitate, arrange, recommend, or promote any form of credit, lending, or debt product. The debt tracking feature is solely for recording and monitoring existing obligations. Nothing in the Service constitutes credit advice under the National Credit Act (South Africa), the Consumer Credit Act (UK), or equivalent legislation in any jurisdiction.

15. Anti-Money Laundering

The Service must not be used to facilitate, conceal, or assist with any unlawful financial activity, including money laundering or the financing of terrorism. Any such use is strictly prohibited and may be reported to relevant authorities.

16. Governing Law

These Terms are governed by the laws of the Republic of South Africa to the extent not displaced by mandatory local laws in your jurisdiction. Nothing in these Terms limits any statutory rights you may have under the laws of your own country, including consumer protection rights.

17. Freemium Model, Trials & Affiliates

The Service operates on a freemium model. Premium features are offered for a fee. Pricing is clearly displayed. There are no hidden fees or dark patterns. The 7-day free trial requires no credit card and no payment details — when the trial expires the account automatically reverts to the Free plan with no charge. Users are only charged when they actively select and complete payment for a paid subscription plan (Monthly, Yearly, or Lifetime). Monthly and yearly plans auto-renew until cancelled; lifetime plans are a one-time payment with no renewals. Any affiliate relationships or partnerships will be clearly disclosed and do not influence AI analysis or outputs.

18. Referral Program

The Service includes a voluntary referral program where users may share a unique referral link with others. When a referred person registers via the link, the referring user receives bonus Moo-Milk points (+50 for Free signups, +200 for Premium signups). Moo-Milk points are a gamified scoring system only — they have no cash value, are not redeemable for any currency, goods, or services, and do not constitute any form of compensation, commission, or financial reward. The referral program is not a multi-level marketing scheme, affiliate program, or commission-based arrangement. Referral bonuses are awarded one-time only per referred user and are at the Company's sole discretion. The Company reserves the right to modify, revoke, or terminate the referral program at any time. Self-referral, fraudulent referrals, and referral farming are prohibited and may result in account suspension.

19. Monthly Leaderboard Rewards

The Service may award non-cash rewards to top-performing users on the Moo-Milk leaderboard at the end of each calendar month. Rewards are limited to: (a) a one-month extension of the current Premium subscription period for Monthly and Yearly Premium subscribers; or (b) bonus Moo-Milk points for Lifetime Premium subscribers (converted at a rate determined by the Company, as they receive no benefit from a subscription extension). These rewards have no cash value, are not redeemable for currency, goods, or services, and do not constitute any form of payment, prize, or financial compensation. Only active Premium subscribers (Monthly, Yearly, or Lifetime plans) who have maintained Premium status for the full calendar month are eligible. Free plan users and users on trial are not eligible. The Company determines the number of rewarded positions (currently top 10), the reward amounts, and eligibility criteria at its sole discretion and may modify or discontinue this program at any time without prior notice. Leaderboard rankings are based on Moo-Milk points earned during the relevant month and are final.
